Welcome to hronline 

 

Thank you for using hronline which is provided by Employsure Pty Ltd (ABN 40 145 676 026) of Level 1, 645 Harris Street, Sydney, NSW 2007 ("Employsure").

By using hronline, you are agreeing to these terms of use. Please read them carefully.

If you are a client of Employsure, these terms and conditions also include the terms of the contract for services signed with Employsure ("the Contract"). In the event of an inconsistency between these terms and conditions and the terms of the Contract, the provisions of the Contract shall prevail.

1.         Using hronline 

1.1       hronline and associated services will be unavailable if you or your employer does not renew the licence or maintain the payments as stated in the Contract.

1.2       Do not misuse hronline. For example, do not interfere with hronline or try to access hronline using a method other than the interface and the instructions that Employsure provides. You may use hronline only as permitted by law. Employsure may suspend or stop providing hronline to you if you or your employees do not comply with these terms of use or if Employsure is investigating suspected misconduct. 

1.3       Using hronline does not give you ownership of any intellectual property rights in it. You may not use content from hronline unless you obtain permission from Employsure or are otherwise permitted by law. These terms of use grant you the right to use branding or logos but only in the appropriate place within hronline Company Defaults settings page. 

1.4       In connection with your use of hronline, Employsure may send you service announcements, administrative messages and other information.   

2.         Your hronline Account 

2.1       You need a hronline account in order to use the service. Your account is created for you by Employsure when the Contract commences. Administrators of your hronline account may not change the registration information Employsure holds about you. 

2.2       If you learn of any unauthorised use of your password or account, or if you suspect that someone else knows or has changed your password, please reset it so nobody else can sign in to your hronline account. 

2.3       If you're unable to reset your hronline account password, or you can't sign in to your account, please email hronlinesupport@employsure.com.au outlining the problem and including a phone number that Employsure can ring you back on. Under these circumstances, you will be asked some security questions to prove your identity.  

3.         Privacy and Copyright Protection 

3.1       The Privacy Act 1988 (Cth) (the Privacy Act) allows Employsure to hold and process personal information. Employsure will use the personal information provided in relation to you only for its intended purpose, and in accordance with the requirements of the Privacy Act.

3.2       The hronline privacy statement details how Employsure treats your personal and your employees' information and protects your privacy when you use hronline. By using hronline, you agree that Employsure can use such data in accordance with the privacy statement. 

3.3       Copyright of all materials provided pursuant is reserved by Employsure as a group company of Peninsula Business Services Ltd without whose written permission it may not be reproduced or modified.

4.         Your Content in hronline

4.1       hronline allows you to submit content which is stored in its document library. You retain ownership of any intellectual property rights that you hold in that content. It is a condition of use of hronline that you do not upload content (for example music or videos) for which you do not hold the copyright. 

4.2       Insofar as you seek advice from Employsure about an employee, the limit of any shared responsibility for that employee's data is their forename, surname, start date and job title. All other content relating to your employees is your sole responsibility. However, in accepting these terms of use, you give approval to suitably authorised Employsure staff to review the other content about an employee in order to ensure that the advice you are given is based on the relevant data. 

5.         Modifying hronline

5.1       Employsure regularly updates and improves hronline. The right to add or remove functionalities or features and/or suspend or stop a function altogether is therefore reserved.

5.2       If you are a client, you can stop using hronline at any time but cancellation must be completed in line with the Contract.

5.3       Employsure may add or create new limits to hronline at any time. 

5.4       Employsure believes that you own your data, and preserving your access to such data is important. If hronline is discontinued, where reasonably possible, Employsure will give you reasonable advance notice and a chance to remove information from it.  Employsure will retain employee information for a period of 12 months after the Contract ends before it is deleted.

5.5       If you are a client, in the event that you request your transactional data from hronline, Employsure's responsibility would end at the point of providing you with ".csv" output files for your employees exactly as they exist within hronline. The responsibility for that data remains with the client. 

5.6       hronline provides you with the ability to export most of your fixed employee data and your absence transactions to Microsoft Excel.  Peninsula's responsibility in allowing you to extract your data is limited to these two data exports.

6.         Warranties, Indemnities and Disclaimers 

6.1       If you are a client, you warrant that you have provided all notifications, procured all consents and taken any other steps necessary to ensure that your collection, storage and use of and disclosure to Employsure of your employee's personal information (including sensitive information) and that Employsure's collection, storage, use and disclosure of that information (in accordance with the privacy statement) is permitted by and complies with the Privacy Act.

6.2       If you are a client, you warrant that you have and will continue to comply with the Privacy Act.

6.3       If you are a client, you forever release, hold harmless and indemnify Employsure, its affiliates, officers, employees and agents from all present and future claims, actions, demands, proceedings and penalties of any kind arising from or in relation to their or your collection, storage, use or disclosure of your employee's personal information, including any liability or expense arising from claims, losses, damages, judgements, litigation costs or legal fees.

6.4       hronline is provided using a commercially reasonable level of skill and care.

6.5       Other than expressly set out in these terms of use or the terms and conditions (in respect of clients), neither Employsure nor its suppliers or distributors makes any specific promises about hronline.

6.6       Any verbal representations made at the point of sale are specifically excluded.

7.         Liability for our Services 

7.1       Where permitted by law, Employsure will not be responsible for lost profits, revenues or data, financial losses or indirect, special, consequential, exemplary or punitive damages. 

7.2       To the extent permitted by law, the total liability of Employsure for any claims under these terms, including for any implied warranties, is limited to the amount that you paid us to use hronline (or, if Employsure elects, to supplying you with hronline again). 

7.3       In all cases, Employsure will not be liable for any loss or damage that is not reasonably foreseeable.   

8.         Business users of hronline 

8.1       If you are using hronline on behalf of a business, that business accepts these terms.  It will hold harmless and indemnify Employsure and its affiliates, officers, agents and employees from any claim, action or proceedings arising from or related to the use of hronline or violation of these terms, including any liability or expense arising from claims, losses, damages, judgements, litigation costs or legal fees.

9.         About these Terms 

9.1       Employsure may modify the "Terms of Use" that apply to hronline.

9.2       In the event of a change you will be notified via the "My Account" section of hronline 14 days prior to the change.
